any genuine issue of material fact. [316-318] On a claim for malicious prosecution, summary judgment was properly ordered for the defendant, where her statements to police
accusing the plaintiff of planning with her to steal money from the bank where both were employed, which were made while the
defendant was herself a suspect in a theft already under investigation, did not, as matter of law, constitute the initiation
of criminal proceedings against the plaintiff. [318-319]
