Four actions in the Hennepin County District Court arising out of the collision of an automobile owned by Eugene Alton and driven by Michael Alton with a taxicab owned by George R. Davidson, d.b.a. Red and White Airway Taxi Company, and driven by Gary L. Raymond, who died as a result of the accident. Two of the actions were for personal injuries, one by Patricia Lott, a passenger in the taxicab, was brought against the Altons and Davidson; one on behalf of a passenger in the Alton automobile, Marie G. Spath, a minor, was brought by Allen N. Spath, her father and natural guardian, against the Altons, who filed a third-party complaint against Davidson. An action by Betty Raymond, trustee for the heirs of Gary L. Raymond, for death by wrongful act and one by George R. Davidson for property damage were brought against the Altons. The cases were consolidated for trial before Dana Nicholson, Judge, and the jury found in a special verdict that the negligence of Raymond did not cause the injuries to his passenger and that there was no contributory negligence or assumption of risk on the part of Marie Spath. The Altons appealed in each case from a judgment entered against them and from an order denying their motion to set aside the special verdict or in the alternative for a new trial.
